RESIDENT AND RESIDENT’S OCCUPANTS AND GUESTS MUST COMPLY WITH ALL WRITTEN RULES, REGULATIONS AND POLICIES PERTAINING TO THE PREMISES AND THE APARTMENT COMPLEX. THESE RULES AND REGULATIONS ARE SPECIFICALLY INCORPORATED INTO YOUR RESIDENTIAL LEASE AGREEMENT.
1. Parking. Resident is authorized to park (see individual Rental Agreement) vehicle(s) within the Apartment Complex. Resident agrees to inform Landlord of any vehicle changes, including a new vehicle, change in license plate, etc. All vehicles must be properly registered, currently licensed (In-Transit signs will be honored for the legal 30-day period), and in operable condition. Any vehicle that remains stationary for a 72-hour period or more and are in violation of the above stated conditions will be subject to being towed at the owner’s expense after a 24-hour notice has been left on the vehicle or Resident’s Premises.
a. Permits. Parking Permits should be placed in the following locations depending upon the Apartment Complex:
b. Towing Policy. The parking lot(s) within the Apartment Complex are reserved for residents only between the hours of 10:00 pm and 6:00 am. Any vehicle, whether it belongs to a resident or not, without a proper Parking Permit will be subject to being towed during the aforementioned time period, at the expense of the Resident or their guest. Vehicles that are improperly parked (e.g. taking up more than one space, parked in a handicap spot without proper identification, etc.) with or without a parking permit, are subject to being towed at any time of the day. Landlord will not be held responsible for any towing costs or damages from such removal.
c. Prohibitions. Vehicle repairs or washing are not permitted in the parking lot(s) or garages, unless a designated car wash station is indicated within the Apartment Complex.
2. Smoking. No Resident shall smoke, nor permit anyone to smoke, in the Resident’s Premises. Smoking shall be prohibited in common hallways, stairways, foyers, laundry rooms, storage or package rooms, office, fitness room, and garages.
a. Definitions. Smoking shall include the inhaling, exhaling, breathing, carrying, or possession of any lighted cigarette, cigar, pipe, other products containing any amount of tobacco and any other ignited smoking substance. Use of cannabis is illegal on the entire grounds according to Nebraska state law.
b. Designated Smoking Areas. Smoking shall be permitted outside on the Apartment Complex grounds except anywhere that is designated as a smoke-free area including, but not limited to, the pool area if applicable. This shall include a resident’s patio or balcony. All cigarette butts MUST be disposed of properly. Any damage caused by improper disposal of cigarette butts will be charged back to the responsible Resident. Resident shall inform Resident’s occupants and guests of the no smoking rule.
c. Damages. Resident understands and agrees that any damage caused by or related to cigarette, pipe, or cigar smoking, or any ignitable product shall not constitute ordinary wear and tear. Landlord may deduct from Resident’s Security Deposit for all damages and/or costs for the cleaning or repairing of any damage caused by or related to any tobacco product, including, but not limited to: deodorizing the apartment, sealing and painting the walls and ceilings, and repairing or replacing the carpet and/or pad.
d. Disclaimer. Resident acknowledges the following:
3. Keys. Upon termination of the Lease, all keys/fobs shall be returned to Landlord or Resident will be charged any applicable costs, including re-keying the unit, building, mailbox, etc., as well as the costs of new keys for residents in the other units if the building must be re-keyed. Resident will also be responsible for any lock, key/fob and labor charges if locks must be changed during occupancy due to loss or damage caused by Resident.
a. Related Fees. If Resident locks themselves out of the building, apartment, or garage, contact the office or emergency maintenance phone number during non-office hours. Landlord reserves the right to unlock the unit or furnish a duplicate key at a convenient time and place determined by Landlord. The following charges will apply and are to be paid at the time of the lock out:
4. Miscellaneous. Resident hereby agrees to use or maintain the Premises or Apartment Complex as follows:
a. To use the highest degree of care to keep the premises safe, clean and sanitary, and to comply with applicable standards of the Housing and Building Codes. To use all electrical, plumbing, heating, ventilating, air-conditioning, and other facilities in a reasonable manner, and to use appliances only for their intended use.
b. To conduct himself/herself and all guests in a manner which will not disturb his/her neighbors’ peaceful enjoyment of the premises and to assure that the conduct of all guests or pets is in such a manner that will not harass, embarrass, or needlessly make complaints to Landlord. Parties are not allowed.
c. To not keep pets or animals of any kind on the premises without written consent of the Landlord.
d. To not make any changes, remodel, redecorate, or paint.
e. To not install any additional major appliances, including but not limited to, portable washers and dryers, without the prior written approval of the Landlord. If allowed, Resident agrees to pay additional utility costs for same.
f. To not attach to or hang from the walls anything weighing more than one pound without written consent of the Landlord. Small nails may be used, but do not use adhesive on the walls, or nails in the woodwork or cabinets.
g. To refrain from littering on the premises.
h. Resident is responsible for any minors living in or visiting the unit and must supervise them on the grounds at all times.
i. To pay for all repairs resulting from his/her misuse of Premises by Resident, his or her family, guests, or pets.
j. Not to act or use the Premises in any way that would be deemed hazardous by the insurance carrier.
k. To store personal property such as bicycles, autos, motorcycles, boats, trailers, etc. only in areas specifically approved by Landlord. Bicycles are not to be stored on the patio or balcony. If your property has a bike garage you may get a key from the rental office.
l. To promptly notify Landlord of any known need for repairs to the dwelling unit or premises. Every effort will be made to handle these requests as quickly as possible. Please limit evening and weekend calls to emergencies only!
m. To not store any items in the furnace closet, prop the furnace closet doors open, or block air intake vents outside of the furnace. Failure to comply can result in a fire that endangers not only your life, but the lives of others in the building. Anyone who fails to adhere to the policy will be held responsible for any damages resulting.
n. To not prop the building entry doors, laundry doors, or fire doors open at any time and to not allow entrance to anybody that is not your guest. Soliciting is not permitted.
o. To not display any signs, flags, or exterior lights or markings on the Premises or within the Apartment Complex (this includes any signs, flags, banners, or markings displayed in any windows); provided, however, Resident may display the traditional flag of the United States or a flag from an officially licensed vendor for the University of Nebraska from his or her patio or balcony, not to exceed 3 feet by 5 feet.
p. To not keep personal belongings in the hallways.
q. To keep grounds and patios clean and tidy at all times and agree not to store or hang rugs, laundry, clotheslines, or other household items on the patio or balcony.
r. To observe posted rules (listed below and/or posted directly in the room/area) for the use of the laundry room, clubhouse, fitness center, and/or swimming pool to the extent these facilities are included within the Apartment Complex.
s. To cooperate with Landlord in keeping the unit free of rodents and other pests. To permit entry and spraying (or other measures required for pest control) by Landlord or a pest control company. Residents may be liable for pest control costs.
t. To maintain and replace smoke detector batteries and light bulbs, excluding fluorescent lights, which shall be the sole responsibility of the Resident. Resident shall notify Landlord immediately of any deficiencies.
u. To not install a satellite dish, or any other fixture that must be attached to the property, without the written consent of the Landlord.
v. To not install any surveillance cameras or recording devices outside of Resident’s unit that interferes with another tenant’s privacy. Any cameras or devices must be wireless and not require any drilling or electrical work. Resident agrees to pay for any repairs or repainting needed after the removal of the same.
w. To not store or use fire pits, charcoal grills, or propane grills with a water capacity more than 2.5 pounds (nominal 1-pound LP-gas capacity) on the premises, except those that are provided for resident use in common areas, to the extent included in the Apartment Complex. Electric grills are permitted. Resident will be responsible for any fines/fees issued by the City Fire Inspector. Please refer to the City of Lincoln Fire Code for any questions.

z. To not have water-based furniture (e.g. waterbed, aquarium) without written consent of Landlord.
aa. If storage units are available at the Apartment Complex, they may be rented, for an additional monthly fee.
5. Pool Area Rules and Regulations. To the extent that a pool is included within the Apartment Complex, Resident hereby agrees to observe the following Rules and Regulations and any signs posted at the Pool Area:
